経済産業省に勤めるトランスジェンダー女性職員の施設利用に関する最高裁判所判決についての声明

7月11日、経済産業省に勤めるトランスジェンダー女性の職員が、職場における女性用トイレの使用を制限されているのは不当だとして国を訴えた裁判で、最高裁判所は、トイレの使用制限を認めた国の対応は違法だとする判決を言い渡しました。 

本判決では5人の裁判官全員が内容を補足する個別意見を述べています。その中で、自認する性別に即して社会生活を送ることは、誰にとっても重要な利益であること。特にトランスジェンダーの人々にとっては切実な利益で、法的に保護されるべきものであること。また、性別は人格的な生存と密接不可分で、利害調整を感覚的・抽象的に行うことは許されない、といった重要な指摘がなされています。 

トランスジェンダーの人々に対する、まさに感覚的・抽象的な偏見、事実誤認や歪曲などに基づくバッシングや排除が今もなお続いている現状があり、強い不安感と孤独感を抱えている人々、そしてトランスジェンダーの人の人権保護のために闘い続けている人々にとって、「人権の最後の砦」といわれる最高裁判所による明確なメッセージは、力強い支えになるものと受け止めています。 

プライドハウス東京コンソーシアムは、「すべての人が、性のあり方によって取り残されることなく、平等に、すこやかに生きられる社会づくりに貢献し、さまざまな分断を超えるための希望と経験を創出します」というミッションを掲げて活動をしています。今回の判決は、私たちが取り組んできた、トランスジェンダーの人々も含め、いかなる性のあり方の人も尊重し、誰もが安心して過ごせる社会変革の実践を確かなものにする内容です。これを契機に、LGBTQ+の人権尊重と理解増進の機運がさらに前進し、LGBTQ+の人たちが安心して生きられる社会が実現することを心から願い、私たちも実践を継続していきます。

We write this letter to express our profound support and gratitude for the recent Supreme Court decision in the case involving a transgender employee of the Ministry of Economy, Trade and Industry (METI) who challenged workplace restroom restrictions. The Court ruled that the government’s prohibition on her use of the women’s restroom was illegal. 

The ruling holds immense significance, as each of the five justices contributed their individual opinions, underscoring the importance of this decision. We are particularly heartened by the Court’s recognition that living authentically in accordance with one’s self-identified gender identity is a fundamental right for every individual. The Court acknowledged the heightened significance of this right for transgender people and stressed the need for legal protection. They emphasized that gender identity is inseparable from personal survival and unequivocally rejected the notion of trivializing or abstractly weighing such fundamental interests. 

However, we cannot ignore the prevailing atmosphere of prejudice, exclusion, and misrepresentation that continues to target transgender individuals. Biases rooted in impulsive and speculative notions, factual inaccuracies, and distortions persist, fueling discrimination. This Supreme Court ruling, often regarded as the “last bastion of human rights,” delivers a resolute message of support to those unwaveringly advocating for transgender rights and fighting for the protection of human rights as a whole. 

Pride House Tokyo Consortium is dedicated to the mission of creating a society where every individual can live equally and healthily, irrespective of their sexuality or gender identity. Our aim is to foster hope and generate experiences that transcend the divisions that exist. This ruling reaffirms our unyielding commitment to effecting social change that respects the rights and dignity of individuals of all gender and sexual identities, including transgender people, thus enabling peaceful coexistence for everyone. We sincerely hope that this ruling will serve as a catalyst for further progress in promoting respect and understanding of LGBTQ+ human rights. Together, let us strive to realize a society where LGBTQ+ individuals can live in harmony. We pledge to continue our unwavering efforts towards this transformative vision.
