「LGBT理解増進法」に対する懸念の表明と差別を許さない運用のための声明

6月16日の参議院本会議にて、「LGBT理解増進法案（正式名称：性的指向及びジェンダーアイデンティティの多様性に関する国民の理解の増進に関する法律案）」が、議員立法の全会一致の不文律に反する形で成立しました。

LGBTQ+当事者に対する差別を禁止する法律は、社会の中で偏見や差別を受けているLGBTQ+当事者にとって、安心・安全に生活を送るために必要不可欠なものです。

しかしながら、本来はLGBTQ+当事者が今もなお受けている差別や困難を解消するための法案だったにも関わらず、紆余曲折を経て、今回成立した法律がLGBTQ+当事者への差別を助長し、より困難な状況を強いる危険性がある内容となってしまったことに対する悲しみや憤りの声が上がっています。

特に、法案の審議の過程で十分な議論もないなか追加された、「性的指向又はジェンダーアイデンティティにかかわらず、全ての国民が安心して生活することができることとなるよう、留意するものとする」という文言により、LGBTQ+当事者への理解を増進する活動や取り組みは多数派への配慮が前提となると捉えられる可能性があります。これは「多数派が不安だ」と言うだけで、LGBTQ+の啓発活動に歯止めをかける効力の可能性を意味します。また、「家庭及び地域住民その他の関係者の協力を得つつ」という文言の追加は、家庭や地域からの協力を得られなければ、LGBTQ+に関する啓発活動すらできないと捉えられる危険性があります。

さらに、今回の法案の成立によって、特にトランスジェンダー女性に対する差別を助長する恐れがあることも危惧されています。実際、トランスジェンダーの人々に対する実態とかけ離れた事実誤認や歪曲、差別や偏見に基づく発言などが継続的に行われており、SNS上などでそれが増幅され拡散されるという過酷な状況があります。また、プライドハウス東京コンソーシアムが設立当初から取り組んできたスポーツの現場においても、トランスジェンダー女性が排除される動きが活発になっています。トランスジェンダーの方々の命や健康に重大な悪影響をもたらし、排除や抑圧を深めるものとして、私たちはこうしたヘイトスピーチの拡散に強い懸念と抗議の意を表明します。

プライドハウス東京コンソーシアムは、本法律の懸念点を厳しく批判し、内容の見直しを強く要望します。また、LGBTQ+当事者への差別の助長につながることがないように、今後も本法律の運用を厳しく注視し、LGBTQ+当事者の実態を踏まえた提言等を行っていくことを表明します。あわせて、識者・当事者団体らの声を法律を運用する際にきいていただけるよう、要望します。

さらに、全国各地のLGBTQ+支援団体、専門家、民間企業、大使館、スポーツ団体・関係者、ジェンダー平等やマイノリティ支援に取り組む様々な団体の皆さんをはじめ、あらゆるステークホルダーと連携し、本法律の原点を見据え、適切な運用がなされる取り組みを進め、誰も排除されないLGBTQ+インクルーシブな社会を共に実現することを呼びかけます。

Statement of Concern Regarding the “Bill for the Promotion of Understanding of LGBT People” and Its Non-Discriminatory Implementation

On June 16, during a plenary session of the House of Councillors, the “Bill for the Promotion of Understanding of LGBT People (formerly known as the Bill for the Promotion of Public Understanding of Diversity in Sexual Orientation and Gender Identity)” was passed in violation of the unwritten rule of unanimity for parliamentary legislation.

However, despite the fact that the bill was originally intended to eliminate discrimination and difficulties faced by LGBTQ+ individuals, the law that was passed after a series of twists and turns has the potential to foster discrimination against LGBTQ+ individuals and intensify their struggles. This has caused quite a sense of sadness and outrage among the LGBTQ+ community.

Of particular concern is the inclusion of the statement “care shall be taken to ensure that all citizens, regardless of sexual orientation or gender identity, are able to live in safety” without adequate discussion during the bill’s deliberation process. This wording implies that activities and initiatives are grounded in the concerns of the majority. The mere mention of “majority concern” undermines the efforts to raise awareness about LGBTQ+ issues. Furthermore, the inclusion of the phrase “with the cooperation of families, local residents, and other interested parties” insinuates that educational activities related to LGBTQ+ matters are contingent upon the involvement of families and communities.

We are alarmed by the potential consequences of this law, particularly for transgender women who are at a heightened risk of discrimination. The proliferation of misrepresentations, distorted facts, discriminatory remarks, and hate speech against transgender individuals on social networking sites is deeply disturbing. Even in the realm of sports, where our consortium has tirelessly worked, transgender women face increasing exclusion. Such acts of hate speech inflict severe harm on the lives and well-being of transgender individuals, exacerbating their marginalization and oppression.

We, the Pride House Tokyo Consortium, vehemently condemn the concerns raised by this law and demand an immediate review of its provisions. We pledge to closely monitor the law’s implementation to prevent any promotion of discrimination against LGBTQ+ individuals. Drawing upon the real-life experiences of LGBTQ+ people, we will offer recommendations and proposals. Additionally, we insist that the voices of LGBTQ+ experts and organizations be given due consideration during the implementation process.

Furthermore, we vow to collaborate with all stakeholders, including LGBTQ+ support groups nationwide, experts, private companies, embassies, sports organizations, and related parties, as well as various groups dedicated to gender equality and minority support. Together, we will ensure that this law is implemented in line with its original intent, leaving no one marginalized or excluded. We call upon all stakeholders to unite in the pursuit of an inclusive society that embraces LGBTQ+ individuals without exception.
